Unhappy prospective juror says he'd rather go to jail, gets his wish

Associated Press

BATON ROUGE -- A potential juror who told a judge he would rather spend time in jail than return for another day of official service was granted his wish.

Derrick Gibson, of Baton Rouge, received 10 days in jail from State District Judge Richard Anderson, who found Gibson in contempt.

"That is about as defiant a juror as I have ever seen," A nderson said Thursday during a break in the second-degree murder trial for which Gibson had been called for jury duty. "I'm tired of people who don't respect the whole system," the judge said.

Anderson said he expected Gibson would be released Saturday -- roughly the same amount of time he would have served had he been picked for the jury -- because of two-for-one "good time."

Anderson said he gave the prospective juror the opportunity to reconsider his position before he ordered him to jail. The judge said Gibson told him he could not miss work -- a common problem solved by rescheduling jury service.

Had he been chosen for the jury, Gibson have been off the hook Thursday when a mistrial was declared in the trial.

Jury Duty would be awesome. I'd love to serve. Been called up before, but always excused because of my background in the legal field; however, I did fill out a rather long jury questionairre for the U.S. District court which will go into a pool for three years. There may be hope yet!

I can't believe he didn't want to serve. Glad the judge had the nads to stick it to him.
